Terms and Conditions

1.0 risk & property
1.1	Risk in the terms purchased to Buyer’s acceptance of the invoice. Property in the terms shall be passed to Buyer upon receipt of full payment by us.

2.0 cancellation and/ or reschedule
2.1	Buyer is deemed to have accepted the items upon issue of this invoice.
2.2	Orders placed for same day delivery and/ or next day delivery cannot be cancelled or rescheduled after the order has been confirmed. Orders placed for delivery day after 48 hours or longer can be cancelled and/ or rescheduled subject to the payment of a 50% Handling Charge that such cancellation and/ or reschedule request is made in writing and fax to us at 2529 2569 and/ or email to us at sales@ovogarden.com.hk for at least 1 business day before the original requested delivery date.
2.3	Custom orders, functions, venue decorations cannot be cancelled and/ or reschedule under any circumstances unless otherwise agreed in writing at the time the order is placed.

3.0 claims
3.1	Any claims regarding damaged or defective goods must be made either on the date of purchase or on the date of delivery.
3.2	Due to seasonal availability, weather condition and other factors beyond our control, not all products shown on our website, catalogue or shop display are available at all time. Substitution of flowers in similar value and style may be applied. You will be advised at the time of ordering about the substitution of main flowers. Substitution of accompanying flowers may be applied without notification but will be of comparable value and colour.
3.3	As flowers are natural products, colours and scales may vary from that shown in our website, catalogue or shop display. However, we will make every effort to maintain the colour scheme, size and shape of the flower arrangements.
3.4	Standard packing will be applied for flower bouquets. Special packing will be subjected to a surcharge.

4.0 delivery
4.1	Morning deliveries will be made between 10:00am to 1:00pm and afternoon deliveries between 2:00pm to 7:00pm. A surcharge will be made if you wish to arrange delivery within a narrower time-period or at a specific time.
4.2	Deliveries to outlying islands will be accepted on a case by case basis. You are welcome to call our florist at 2529 2599 for inquiry.
4.3	Delivery will be suspended and re-scheduled when a typhoon signal No.8 is hoisted or black rainstorm warning is in effect. Further rearrangement of the delivery service will be made.

5.0 delivery charges
5.1	Delivery service is only available for purchases over hk$500 to an address with vehicular and lift access.
5.2	Our delivery service covers local areas and charge is subjected to products and locations.
5.3	Express delivery refers to same day delivery or delivery at specific hours. Express delivery service will be subjected to a surcharge of hk$100 for delivery to Hong Kong Island, hk$150 to Kowloon and hk$200 to New Territories.
5.4	We reserve the right to impose an additional delivery charge for re-delivery arrangement and if we have to make additional attempts due to incorrect or incomplete delivery particulars.

6.0 extent of duty
6.1	In case of products provided by Buyers, all risk of damage or loss during storage, process or transit shall be Buyer’s.
6.2	Flowers are very fragile. Proper care of flowers will ensure longer vase life.

7.0 exclusion of liability
7.1	We shall not be liable for any additional expenses nor for damage to property or injury to persons on Buyer’s premises arising from delivery or use of the items purchased, however caused.

8.0 ordering
8.1	Orders placed online, by email or fax must be confirmed by our florist by phone, email or fax before such orders are accepted. Please give us at least 1 day for order processing. For same day or urgent orders, please call us by phone at 2529 2599 to confirm the order during our opening hours.

9.0 payment
9.1	Payment can be made online using paypal, FPS, Payme or via bank deposit.
	You can deposit to our bank accounts and fax a copy of the deposit slip to us within 1 day upon confirmation of order.

9.2	Full payment shall be paid upon confirmation of order. Delivery will be made only after payment is received.
9.3	An interest rate of 3% per month based on the outstanding amount will be added for late payment.

10.0 changes
10.1	We reserve the right to change these conditions of sales at any time and without prior notice. In case of a dispute, we have the right to final decision.

11.0 proper law
11.1	This contract is subject to the laws of the Hong Kong Special Administrative Region.
